Cybersecurity 2016: Managing Cybersecurity Incidents

In this One-Hour Briefing, we will explore ethical and practical issues related to law firm data security obligations.  In light of recent cybersecurity breaches at major firms – not to mention the disclosure of the “Panama Papers” – cybersecurity should be among a law firm’s top priorities.  Specific ethical rules in the Code of Professional Responsibility require lawyers to safeguard client information, giving rise to a host of practical, commercial and legal issues.  And what becomes clear is that there is not a “one size fits all” solution for lawyers or their firms.  With our panelists, we will discuss these issues from several vantage points including those of a law firm general counsel, data privacy lawyer, and former Federal prosecutor.

Topics to be addressed include:

  • Overview of ethical rules governing data security
  • Implications of ethical rules in today’s cyber threat environment
  • Preparation, preparation and preparation – challenges and strategic approaches
  • Practical “take-aways” for law firms in dealing with data security

Panelists:

Tomas Brown, former Assistant United States Attorney, Southern District of New York,  Cyber Crime Unit.  Mr. Brown is currently a Managing Director and Global Leader of Berkeley Research Group’s Cyber Security/Investigations Practice

Michelle W. Cohen, Partner, Patterson Belknap Webb & Tyler LLP
