Overview
The development of the metaverse has heightened concerns about the protection of children’s online privacy. California recently enacted the state’s Age-Appropriate Design Code Act. The Act covers certain businesses that provide an online “service, product, or feature” that is likely to be accessed by children, defined as anyone under 18. The Act requires companies to configure their default privacy settings to “offer a high level of privacy” and prohibits children’s private information from being used in a way that is “materially detrimental” to their health or wellbeing. The Act will be enforced by the California Attorney General.

- Potential risks to children’s privacy in the metaverse (15 minutes)
- What the California Design Code Act requires and prohibits, and what that could mean for metaverse designers and developers (15 minutes)
- The status of COPPA and the recent letter sent by Congress to the FTC asking the agency to prioritize that law (10 minutes)
- Which agencies and legislatures might seek to regulate the metaverse (10 minutes)
- Does the announcement by Roblox of its intention to create age-appropriate guidelines for experiences and games signal a trend of self-regulation by metaverse stakeholders? (10 minutes)
