IP Discussions with Joshua Simmons is a series of conversations hosted by nationally recognized intellectual property litigator, Joshua Simmons. Each month, Josh is joined by a panel of IP luminaries, leading scholars, and industry insiders. Together, they examine major topics and events in a civil, roundtable format.
Although substantive intellectual property law is critically important to the modern IP lawyer, it cannot be underestimated that, because many IP disputes are resolved through litigation, an appropriate IP litigation strategy is equally important. Such strategies include consideration of the forum in which to litigation, both the type of tribunal and its geography. For example, IP claims that follow regional circuit law can be won or lost based on that circuit’s interpretation of relevant IP strategies. Even for patent claims, however, differences between courts can have significant differences.
