This program is a video replay of the “Hiring and Affirmative Action in 2024” and “Pregnancy, Accommodation and Caregiver Discrimination” segments from the “Employment Discrimination Law & Litigation 2024” program. 


Why You Should Attend

For the last several years we have been experiencing major developments in the evolution of employment discrimination law. Case law, technology and new legislation have all contributed to reshape the landscape in dramatic ways. The Supreme Court issued a landmark decision last year that will have a profound effect for years to come on affirmative action and diversity efforts in the workplace. In addition, there are new theories of discrimination and new developments in existing theories including hostile work environment claims, disability discrimination and accommodation, gender identity, religious discrimination and accommodation, and more. Artificial intelligence continues to promise impact in the employment arena as well.

What You Will Learn

The first panel focuses on the legal developments surrounding pregnancy, accommodation, and caregiver discrimination in the workplace. Attendees will learn how to advise clients on complying with current regulations, navigate accommodation requests and understand legal requirements surrounding lactation provisions. The panel will also cover how to identify and respond to claims of caregiver discrimination and explore the anticipated impact of the 2023 Pregnant Workers Fairness Act.

The second panel addresses hiring practices and affirmative action. Attendees will learn to identify and avoid practices that could lead to legal liabilities, understand the permissible affirmative action practices in recruiting and hiring, and explore legal risks associated with incorporating AI into the hiring process.
