Defending against an unlawful detainer has become more complex as State-enacted protection for tenants expire and local jurisdictions begin to wind down their COVID-19 tenant protections.
Successfully defending an unlawful detainer is a profound way to impact a tenant’s life; housing instability and homelessness have long-term harmful consequences. For attorneys with limited litigation experience, the fast-paced unlawful detainer is also an excellent opportunity to further develop litigation skills; your case may be heading into trial only a month after the summons and complaint are served. This training provides the advanced knowledge you will need to effectively defend tenants from eviction, including COVID-related protections.
What You Will Learn
After completing this program, participants will be able to:
- Identify what, if any, COVID-19 tenant protections may still be used as affirmative defenses
- Draft an effective answer to an Unlawful Detainer Complaint and spot defects in eviction notices
- Strategize and execute the use of responsive motions to attack faulty notices and complaints
- Identify fair housing issues for tenants impacted by COVID-19
- Recognize and apply anti-discrimination housing laws in cases for tenants who were previously involved in the criminal legal system
- Defend the rights of tenants in Low Income Housing Credit units
