Biography
Michelle M. McGreal is a partner in the Banking and Finance practice specializing in restructuring and bankruptcy.
Ms. McGreal is a member of the Bar of the State of New York and is admitted to practice before the U.S. District Court for the Southern District of New York. She is the former chair and now a member of the Eastern District of New York's Chapter 11 Lawyers' Advisory Committee. Prior to practicing, Ms. McGreal clerked for the Honorable Stuart M. Bernstein, United States Bankruptcy Court for the Southern District of New York (2007-2009).
In her practice, Ms. McGreal represents creditors, debtors, agent banks, lenders and other strategic parties in a wide range of corporate restructurings, including traditional bankruptcies, out-of-court workouts and financing transactions. This experience includes:
- Nordic Aviation Capital (NAC), the world’s largest regional aircraft lessor, on the US aspects of its successful restructuring of approximately US$6 billion of debt through a scheme of arrangement, including obtaining recognition of the scheme under chapter 15 of the US Bankruptcy Code, and as special counsel in connection with its subsequent chapter 11 proceedings
- An ad hoc committee of majority senior secured noteholders in connection with Voyager Aviation LLC’s chapter 11 cases
- Multiple aircraft lessors and finance parties in connection with the pre-arranged chapter 11 case of Philippine Airlines and the chapter 11 cases of SAS, GOL Airlines and Spirit Airlines
- The purchaser of substantially all of the assets in the Sam Ash chapter 11 cases
- FMO, the Dutch Entrepreneurial Development Bank, as a secured lender to Mercon Coffee Group in connection with its chapter 11 cases
- Natixis as lead arranger and a commercial bank syndicate in the restructuring of a US$350 million COFACE-backed financing for a US-to-Brazil undersea cable system in connection with the Seabras chapter 11 case
- Codere, the Spanish headquartered gaming and casino business, in connection with recognition in the US of its UK restructuring through a chapter 15 proceeding
- BlackRock and Silver Point Capital in connection with a US$350 million asset-based term loan facility for InfraBuild, Australia’s largest vertically-integrated steel manufacturer and distributor.
- BlackRock in connection with a $150 million secured term loan facility for Puttshack, a tech-infused mini golf entertainment venue
- Bank of China in connection with a $400 million exit term loan for GNC in connection with its acquisition out of bankruptcy by a private equity fund
- Certain international financial institutions in connection with their potential exposure in the Hertz chapter 11 cases
- A global asset manager in connection with collateral and credit support matters, structuring considerations, and enforcement and insolvency issues related to its investments in a diversified international aviation and cargo transport company
- Additional senior lender and agent representations for major institutions in connection with in-court and out-of-court restructurings in a variety of industries, including energy, manufacturing, retail and food service
- Various debtor representations in the metals and mining sector, which included successful reorganizations and asset sales
