Overview
Why You Should Attend
The use of artificial intelligence (AI) in law practice is growing rapidly. Lawyers are now harnessing AI to conduct research, draft correspondence, memos and pleadings, summarize and analyze documents and testimony and manage document review in discovery, among other tasks. The use of AI has raised new and complex ethical issues for attorneys, which led to the release of new ethical guidance in 2024.
This program will address the cutting-edge ethical issues arising out of the use of AI. We will discuss what counsel must do to comply with ethical rules when selecting and using AI tools, especially rules governing protection of client information, communication with clients, competent representation, supervision and independent professional judgment. Our experienced faculty of Judges, in house counsel, plaintiffs’ counsel and defense counsel in civil litigation will also cover ethical issues counsel should be aware of that are on the horizon, as AI legal technology continues to evolve.
What You Will Learn
After completing this program, participants will be able to, among other things:
- Comply with the ethical rules governing use of AI, including Model Rules 1.1, 5.3(b), 2.1, 1.6(a) and 1.4
- Understand the impact of the new ABA Formal Opinion 512 (Generative Artificial Intelligence Tools), dated July 29, 2024, on the ethical duties of lawyers
- Appreciate the role of proposed amendments to state rules of professional conduct, and the Federal Rules of Civil Procedure, on the ethical duties of counsel
- Provide legal ethics advice to clients about how AI should and should not be used in legal matters
- Follow best practices to ethically communicate with courts about the use of AI
