Why You Should Attend

The legal requirements for eDiscovery are evolving rapidly, as technology continues to transform fundamentally how litigation is conducted in the United States. This program will provide counsel in litigation involving corporations with information they must know now to satisfy legal and ethical requirements in managing the identification, preservation, collection, processing, search, review, analysis, production, and presentation of electronically stored information (“ESI”).  

We will cover what the precise requirements are, and best practices for counsel to collaborate with key stakeholders in eDiscovery to meet those requirements, including: corporate legal, IT and business departments; law firm lawyers and litigation support professionals; and eDiscovery technology and service providers. The program will deliver real world, practical knowledge from expert lawyers, judges and eDiscovery professionals to achieve cost reduction, risk mitigation and legal defensibility in eDiscovery.

What You Will Learn

After completing this program, participants will be able to:

• Understand the current legal requirements for eDiscovery under the Federal Rules of Civil Procedure (“FRCP”)

• Navigate the current ethical requirements for eDiscovery under the ABA Model Rules of Professional Conduct (“ABA Model Rules”)

• Achieve compliance with the requirements in each of the phases of eDiscovery, and especially when confronted with newer sources of electronically stored information, generative artificial intelligence, and data protected under privacy and security statutes and regulations

• Employ best practices for outside counsel and corporate legal departments to collaborate successfully and succeed in eDiscovery
